About this Privacy Policy

Crucial Lighting Ltd ("Crucial", "we", "us" or "our") operates the Crucial website and online store, including the products, services, content and features made available through it.

This Privacy Policy explains how we collect, use, store and share your personal information when you visit our website, make a purchase, create a customer account, apply for or use a trade account, contact us, subscribe to our marketing communications or otherwise interact with Crucial.

For the purposes of applicable data protection law, including the UK General Data Protection Regulation ("UK GDPR") and the Data Protection Act 2018, Crucial Lighting Ltd is the data controller of the personal information described in this Privacy Policy, except where another organisation acts as a separate controller as explained below.

Our online store is powered by Shopify. Shopify may also provide additional privacy and cookie information during checkout and through its customer privacy features. These notices relate to processing carried out through Shopify and should be read alongside this Privacy Policy.

Personal information we collect

The personal information we collect depends on how you interact with Crucial and may include:

  • Contact information: including your name, billing address, delivery address, email address and telephone number.
  • Customer account information: including information associated with your Crucial customer account, preferences, settings and order history.
  • Trade account information: including your name, company or business name, job title or profession, business address, email address, telephone number, website, business type and other information you provide when applying for or using a Crucial trade account.
  • Order and transaction information: including products you view, add to your basket or purchase, your order history, returns, exchanges, refunds and cancellations.
  • Payment information: including information required to process and confirm payments. Complete payment card details are generally processed by our payment providers rather than directly by Crucial.
  • Communications: including information you provide when contacting us about an order, product, project, trade account, customer service matter or other enquiry.
  • Marketing information: including your marketing preferences and information about your interaction with our marketing communications.
  • Device and technical information: including your IP address, browser type, device information, network information and other online identifiers.
  • Website usage information: including information about how you browse and interact with our website, products, advertisements and communications.

We may also derive or generate information from the above data where permitted by applicable law.

How we collect personal information

We may collect personal information:

  • directly from you, for example when you make a purchase, create an account, apply for a trade account, contact us or subscribe to marketing;
  • automatically when you use our website, including through cookies, pixels and similar technologies;
  • from Shopify and other service providers that help us operate our website and business;
  • from payment, delivery, analytics and marketing providers; and
  • from business partners or other third parties where permitted by law.

Customer accounts

If you create a Crucial customer account, we may process information including your name, contact details, billing and delivery addresses, account information, preferences and order history.

We use this information to create and administer your account, provide account functionality, facilitate checkout, maintain your order history, manage purchases and returns, provide customer support and make it easier for you to shop with Crucial.

Creating a customer account does not, by itself, mean that you have agreed to receive marketing communications from us.

Trade accounts

If you apply for or hold a Crucial trade account, we may collect additional information about you and your business, including your name, company or business name, job title or profession, business address, email address, telephone number, website, business type and other information you provide as part of your application.

We use this information to assess trade account applications, establish and administer trade accounts, provide preferential trade pricing and project support, prepare quotations, process orders, communicate with you about your account and maintain our business relationship with you.

We may also use business contact details to provide information about Crucial products, collections, launches, events and other matters that may be relevant to your business where permitted by applicable law.

You can object to direct marketing at any time by contacting us or using the unsubscribe link contained in our marketing emails.

How and why we use your personal information

We may use your personal information for the following purposes:

  • Providing our services and fulfilling orders: including processing purchases and payments, arranging delivery, managing customer accounts, processing returns, exchanges and refunds and providing customer support.
  • Managing trade relationships: including assessing and administering trade accounts, providing trade pricing, quotations and project support and managing our relationship with trade customers.
  • Communicating with you: including responding to enquiries, providing information about your account or order and handling customer service requests.
  • Marketing and advertising: including sending marketing communications where permitted, measuring the effectiveness of our marketing and, where enabled and permitted, displaying relevant advertising.
  • Improving our website and services: including understanding how visitors use our website, analysing performance, improving functionality and tailoring the shopping experience.
  • Security and fraud prevention: including authenticating accounts, maintaining the security of our website and checkout, detecting and preventing fraud and investigating suspicious or unlawful activity.
  • Meeting legal obligations: including complying with tax, accounting, consumer protection and other legal requirements and responding to lawful requests from courts, regulators or public authorities.
  • Protecting our legal rights: including establishing, exercising or defending legal claims and enforcing our terms and policies.

Our lawful bases for processing

Under UK data protection law, we must have a lawful basis for processing personal information. Depending on the circumstances, we rely on one or more of the following:

  • Contract: where processing is necessary to enter into or perform a contract with you, such as processing an order, taking payment, arranging delivery or administering services you have requested.
  • Legal obligation: where processing is necessary for us to comply with a legal or regulatory obligation, including tax and accounting requirements.
  • Legitimate interests: where processing is necessary for our legitimate business interests or those of a third party and those interests are not overridden by your rights and interests. These interests may include operating and improving our business and website, administering customer and trade relationships, providing customer service, protecting our business against fraud and misuse, understanding business performance and undertaking appropriate business-to-business marketing.
  • Consent: where you have given us consent, including for certain marketing communications and non-essential cookies or similar technologies where consent is required. You may withdraw your consent at any time.

Marketing communications

If you subscribe to Crucial marketing, or where we are otherwise permitted by law to contact you, we may send you information about our products, collections, launches, events, offers and other news.

We use Klaviyo to help manage certain email marketing and customer communications. This may involve processing information such as your name, email address, marketing preferences and your interaction with our emails or website.

You can unsubscribe from marketing emails at any time by using the unsubscribe link contained in the email or by contacting us at contact@crucial.lighting.

Unsubscribing from marketing does not prevent us from sending non-marketing communications that are necessary in connection with an order, account, trade relationship or enquiry.

Cookies and similar technologies

We use cookies and similar technologies to operate our website, remember preferences, understand how visitors use our services, improve website performance and, where permitted, support analytics, personalisation and advertising.

These technologies may include cookies, pixels, tags, scripts and similar technologies provided by Shopify and other service providers.

Some technologies are strictly necessary for the operation, security and functionality of our website and checkout. Others, including certain personalisation, analytics and advertising technologies, are used subject to your choices and consent where required by law.

Shopify provides our cookie consent functionality in applicable regions. You can use the cookie banner and cookie preference controls on our website to manage or change your choices.

Please see our Cookie Policy for further information about the cookies and similar technologies we use.

Analytics and advertising

We use Google Analytics to help us understand how visitors use our website and to measure and improve its performance. Google may process information such as device information, online identifiers and information about interactions with our website, subject to applicable consent requirements.

Where enabled, we may also use advertising, conversion measurement and remarketing technologies provided by platforms such as Google and Meta. These technologies may help us measure the effectiveness of advertising and show more relevant advertisements.

Where consent is legally required for analytics or advertising technologies, we will use them for those purposes only in accordance with your consent choices.

Payments

Payments may be processed through Shopify Payments and PayPal.

Depending on the options available at checkout and your device, payment methods may also include Shop Pay, Apple Pay and Google Pay.

Payment providers process information necessary to complete and secure your transaction in accordance with their own privacy practices. Crucial does not generally receive or store your complete payment card details.

Depending on your location, the delivery service selected and the nature of your order, these providers may include FedEx, DHL Express and other delivery providers made available through Shopify or its shipping services.

Information shared for delivery may include your name, delivery address, email address, telephone number and relevant order and delivery information.

We only share information reasonably necessary to arrange, manage and complete delivery.

Depending on the destination and circumstances, this may include relying on UK adequacy regulations or appropriate contractual safeguards, such as the UK International Data Transfer Agreement, the UK Addendum to the European Commission's Standard Contractual Clauses, or other legally recognised transfer mechanisms.

You may contact us if you would like further information about the safeguards relevant to transfers of your personal information.

How long we keep your personal information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including to provide our services, maintain customer or trade accounts, fulfil orders, comply with legal, tax and accounting obligations, resolve disputes and establish or defend legal claims.

The appropriate retention period depends on the type of information and why we hold it.

For example, we may retain:

  • order, transaction and accounting information for the period required by applicable tax, accounting and legal requirements;
  • customer account information while an account remains active and for an appropriate period afterwards;
  • trade account and business relationship information while the relationship remains active and for an appropriate period afterwards;
  • enquiry and customer service information for as long as reasonably necessary to deal with the enquiry and any subsequent issues; and
  • marketing information until you unsubscribe or object to marketing, while retaining sufficient information where necessary to record and respect your opt-out.

We may retain information for longer where reasonably necessary in connection with a legal claim, dispute, regulatory requirement or investigation.

Security

We take appropriate technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
