Crucial Lighting - Terms & Conditions
These Terms & Conditions apply to the use of the Crucial Lighting website and to purchases made from Crucial Lighting. Please read them carefully before using our website or placing an order.
Nothing in these terms affects your statutory rights as a consumer.
1. About Us
Crucial Lighting is operated by Crucial Lighting Ltd, a company registered in England and Wales under company number 15273073.
In these terms, “Crucial”, “we”, “us” and “our” refer to Crucial Lighting Ltd. “You” and “your” refer to the customer.
If you are purchasing wholly or mainly for purposes relating to your trade, business, craft or profession, our separate Trade Terms & Conditions apply.
2. Our Products
We take reasonable care to ensure that product descriptions, specifications, dimensions, photographs and other information on our website are accurate.
Products may be subject to reasonable manufacturing tolerances and minor variations. Colours and finishes may also appear differently depending on screen settings, lighting conditions, surrounding materials and the type and colour temperature of the lamp used.
Under UK consumer law, goods must be of satisfactory quality, fit for purpose and as described. Nothing in these terms limits those rights.
You should check that a product is suitable for its intended location and use before installation.
3. Mouth-Blown Glass & Finishes
Many Crucial products are made using mouth-blown glass. The nature of this process means individual pieces may have subtle variations in colour, thickness, texture, dimensions, pattern and finish. Small bubbles, markings and other minor characteristics may also occur.
These are natural characteristics of mouth-blown glass and are not normally considered defects. Where several pieces are installed together, some variation should be expected.
Metal finishes may naturally change in appearance over time. Tarnishing, patination, oxidation or discolouration caused or accelerated by environmental conditions, including humidity, condensation, coastal or salt air, heat or chemicals, or by unsuitable cleaning products or methods, are not normally manufacturing defects.
Products should only be installed in environments suitable for their stated specification, IP rating and intended use.
Please see our Glass & Finish Information for further guidance.
4. Orders & Contract Formation
When you place an order through our website, you are making an offer to purchase the products in your order.
We will send you an order acknowledgement after receiving your order. A contract between you and us is formed when we confirm acceptance of your order or dispatch the goods, whichever occurs first.
We may refuse or cancel an order where reasonably necessary, including where a product is unavailable, there is an obvious pricing or product information error, payment cannot be authorised or we reasonably suspect fraudulent activity.
If we cancel an order after taking payment for goods that will not be supplied, we will refund the relevant amount.
We will provide confirmation of your contract in a form that you can retain, normally by email.
5. Prices & Payment
Prices displayed on our website include VAT where applicable and stated.
Any applicable delivery charges will be shown before you place your order.
Payment must be made using one of the payment methods available at checkout.
We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before accepting an order, we may contact you to offer the choice of proceeding at the correct price or cancelling the order.
6. Availability & Delivery
Delivery options, estimated times and applicable charges are shown at checkout or in our Shipping and International Orders information.
We will take reasonable steps to deliver within the stated timeframe. Where no other delivery period has been agreed, goods will normally be delivered without undue delay and within 30 days, as required by applicable consumer law.
Occasionally, delays may occur because of circumstances outside our reasonable control.
Please inspect goods promptly following delivery and before installation. If an item arrives damaged, incorrect or incomplete, please contact us as soon as reasonably possible and retain the product and packaging while we investigate.
7. International Orders
Where international delivery is available, delivery options and costs will be shown at checkout or confirmed before your order is placed.
Unless expressly stated otherwise, customs duties, import taxes, clearance fees and other charges imposed by the destination country are the customer's responsibility.
Customers outside the UK are responsible for checking that products are suitable for use in their destination country. Unless otherwise stated on the relevant product page, our lighting products are designed for 220–240 V, 50/60 Hz.
Nothing in these terms removes any mandatory consumer rights that apply to you under applicable law.
Please see our International Orders information for further details.
8. Installation
Lighting products must be installed in accordance with the supplied instructions, product specifications and applicable electrical and building requirements.
Where appropriate, installation should be carried out by a suitably qualified person.
Before installation, please check that the product is correct, complete, undamaged and suitable for its intended location. If a product appears damaged, incorrect or defective, please do not install it and contact us.
We are not responsible for damage caused by incorrect installation, misuse, unauthorised modification or use contrary to the product's instructions or specifications.
9. 2 Year Guarantee
Crucial lighting products are covered by a 2 Year Guarantee from the date of purchase against manufacturing defects in materials and workmanship under normal use.
The guarantee applies where the product has been correctly installed, used and maintained in accordance with its intended purpose, specifications and supplied instructions.
The guarantee does not cover:
- replaceable lamps or bulbs;
- normal wear and tear;
- accidental damage, misuse or neglect;
- scratches, chips or breakage occurring after delivery;
- damage caused during installation, removal or handling;
- incorrect or unsuitable installation;
- unauthorised alterations, modifications or repairs;
- use outside the product's stated specification or intended environment;
- damage caused by unsuitable electrical supply;
- unsuitable cleaning products or methods;
- natural ageing or changes in the appearance of finishes;
- environmental deterioration, including tarnishing, patination, oxidation or discolouration caused or accelerated by humidity, condensation, coastal or salt air, heat or chemicals; or
- natural characteristics and reasonable variations associated with mouth-blown glass and handcrafted finishes.
Where a valid guarantee claim is confirmed, we will provide an appropriate remedy, which may include repair, replacement of the affected product or component or, where appropriate, a refund.
If the original product is no longer available, we may offer a reasonably equivalent alternative.
The 2 Year Guarantee is in addition to, and does not affect, your statutory consumer rights.
10. Cancellation & Returns
If you are a consumer purchasing online, you normally have the right to cancel your order without giving a reason within 14 days of receiving the goods.
You must then return the goods within 14 days of notifying us that you wish to cancel.
Unless the goods are faulty, damaged or incorrectly supplied, you are responsible for the cost of returning them.
You may inspect the goods as you reasonably would in a shop. We may make a deduction from your refund where the value of the goods has been reduced because of handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.
Your right to cancel does not apply to goods made to your specifications or clearly personalised where the applicable legal exemption applies.
When you validly cancel the entire order, we will refund the price paid and the cost of our least expensive standard delivery option. If you chose a more expensive delivery service, the additional delivery cost is not refundable.
Refunds will be made without undue delay and, where we have not offered to collect the goods, no later than 14 days after we receive the goods back or, if earlier, after you provide evidence that they have been returned.
Refunds will normally be made using the original payment method.
We do not offer exchanges. If you would like another product, please return the original item in accordance with our Returns Policy and place a new order.
Please see our UK Returns policy and, where applicable, EU Right of Withdrawal information for further details.
11. Faulty Goods
Your rights in relation to faulty goods are separate from your right to change your mind and from our 2 Year Guarantee.
Under UK consumer law, goods must be of satisfactory quality, fit for purpose and as described.
If you believe a product is faulty, damaged or incorrectly supplied, please contact us with your order details and a description of the issue. We may ask for photographs or other information to help us investigate.
Nothing in these Terms & Conditions or our Guarantee limits the remedies available to you where goods do not meet your statutory rights.
12. Intellectual Property & Image Use
All intellectual property rights in Crucial products, designs, branding, trademarks, product names, website content, brochures, photographs, product imagery, lifestyle imagery, renders, graphics and other visual content are owned by Crucial Lighting Ltd or the relevant rights holder.
Our website and its content are provided for your personal, non-commercial use unless we expressly agree otherwise.
Images and other content from our website or marketing materials may not be copied, reproduced, altered, republished, distributed or used for commercial purposes without our prior permission.
You must not use Crucial branding, trademarks, photography or other content in a way that falsely suggests an association with, endorsement by or representation of Crucial.
Where we provide approved imagery to a Trade Customer, Retail Partner or other authorised party for the promotion of genuine Crucial products, its use is permitted only for the agreed purpose and remains subject to any guidelines or restrictions we provide.
Permission to use our imagery or other materials does not transfer ownership or any intellectual property rights.
13. Website Use
You must not misuse our website, attempt to gain unauthorised access to it, knowingly introduce malicious software or use it for unlawful purposes.
We may suspend or restrict access to the website where reasonably necessary for security, maintenance or operational reasons.
We do not guarantee that the website will always be available or free from interruptions or errors.
14. Third-Party Links
Our website may contain links to third-party websites or services. These are provided for convenience and do not necessarily mean that we endorse or control them.
We are not responsible for third-party websites, their content or their privacy practices.
15. Liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or liability for fraud or fraudulent misrepresentation.
If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that was not reasonably foreseeable.
Products sold to consumers are intended for domestic and private use unless otherwise stated. We are not responsible under these consumer terms for business losses, including loss of profit, revenue, business or business opportunity.
If you are purchasing for business purposes, our separate Trade Terms & Conditions apply.
16. Events Outside Our Control
We will not be responsible for delays or failures caused by circumstances outside our reasonable control, including manufacturing or supply disruption, transport or customs delays, industrial disputes, natural disasters, government action or disruption affecting our suppliers or carriers.
Where such circumstances affect your order, we will take reasonable steps to minimise their impact and contact you where appropriate.
Nothing in this section affects your statutory rights.
17. Privacy
We process personal information in accordance with our Privacy Policy and applicable data protection law.
Please see our Privacy Policy and Cookie information for details about how we collect, use and protect personal information.
18. Changes to These Terms
We may update these Terms & Conditions from time to time.
The terms applying to a purchase will normally be those in force when the order is placed.
19. Governing Law & Jurisdiction
These terms are governed by the laws of England and Wales.
If you live in another part of the UK or another country, you may also benefit from mandatory rights and protections under the laws applicable where you live. Nothing in these terms removes those rights.
